Policy

Session fees are only refundable within 72 hours of booking. All sales after 72 hours from time of booking for services and product are final and non-refundable. All clients must be paid in full 2 weeks before session date. No exceptions.

Available Discounts:

  • 10% military discount. Military ID required to qualify. Veterans and military spouses qualify.
  • 10% discount for packages that are paid in full at time of booking (includes the retainer for appointment);
  • 5% discount if 2 friends book together;
  • 10% discount per client for groups of 3 or more and 15% for the group organizer. Please see important booking information for Groups and Couples;
  • Rachel offers a 25% discount for Pop Up Events.

Please note that only one discount may be used per client.

Couples sessions may only be booked for the last session of the day which is the 6:30PM start time appointment. Please see important booking information for Groups and Couples.
Males may not enter the venue until other clients have vacated the venue. This is for the comfort of the client finishing her session and . We thank you for your understanding. Couples session are available for a $150 additional fee payable in advance. No male nudity is permitted. Men may be shirtless with jeans only. Images shot female-centric. If Rachel or Angelina feel uncomfortable due to the conduct of the male or couple, she/they will end the session and liquidated damages in the amount of the prepaid package investment will apply.

There are no chaperones of any kind allowed at any sessions. No exceptions. If you would like the comfort of having a friend with you, you are more than welcome to get a friend to book your sessions together. 

If Rachel or her team feel unsafe or mistreated at any time, she reserves the right to refuse service to anyone. RSP reserves the absolute irrevocable right at any time to refuse service to anyone who has abused the client photographer contract and liquidated damages in the amount of the prepaid package applies.

All clients must sign contract online.

Proofs and Product 
Proofs will be delivered two (2) weeks after the date of your session and the proofing gallery is live for seven (7) days for clients to view and make their orders by midnight on the 7th day.

All files will be destroyed after one year from final payment of submitted order. If no order has been submitted, images will be destroyed.

It is Client’s responsibility to make time to view their galleries. No extensions will be awarded without a $50 service charge. No exceptions.

Design of all orders takes three (3) weeks from date of gallery order to complete in-house and then an additional (1) week for our lab to print and ship. Digital files are delivered in a zip file via our secure online servers. Clients may opt to have their digital files delivered on a crystal clear usb drive via USPS for an extra $25 fee.

Rachel Stephens Photography takes utmost care to honor scheduled session times and to deliver products and services as promised. However, should Rachel Stephens Photography or agents be unable to perform services due to severe illness, injury, family crisis, or unforeseen emergency, Rachel Stephens Photography reserves the right to reschedule the session within calendar year or delay product design until time in which design can be properly performed or offer full refund of session fees paid. If any issues beyond our control delay the delivery of orders, RSP will contact clients directly by email.

Only basic retouching is applied to proofs. One image with complete polish will be provided to demonstrate the outcome of images selected for purchase and that the images received for proofing only demonstrate basic retouching. Client will trust Rachel’s talent and vision to produce the same outcome on images selected. Complete retouching will only be applied to images purchased in available packages. Rachel does not retouch to specifications, however, clients will receive a gallery of completed retouched images for approval prior to delivery. At this time, clients may make one revision request for application on all images, not one revision request per image. We DO NOT change you. We polish you. No edits to slim your body or face are permitted. Your satisfaction is of utmost importance to us but all art is subjective. All images will be edited with Rachel’s/Angelina’s professional artistic vision, and, by choosing her as your photographer, you choose the style of their work and trust their judgment through the creative process. We will clean up skin and give you the subtle nips and tucks that improve an image however we do not offer aggressive changing of shape of face, shape of body, the removal of large tattoos or difficult scars, perfect skin tone matching or removal/changing of venue decor.

Expectations
While we strive to make the experience unforgettable, we have removed the risk of clients not ordering by only offering prepaid packages that include the session and product. We do not offer refunds or replacement sessions if a client claims she is not happy with her images. Every client is shot in the same way as the work shown on RSP website in View Galleries Link.

RSP is not liable for issues out of Rachel’s control as pertaining to venue and weather. RSP invests in locations with aesthetically pleasing shooting sets, separate hair and makeup room and separate wardrobe rooms when possible. Venues outside of boutique hotels are only secured through the very reputable sites such as Airbnb and Peerspace and are vetted by Rachel through the photos, reviews and owner correspondence provided through those sites.

To fund these high-end luxury events for our clients, we spare no expense. That said, location is shared as we must book multiple clients through out each 10-hour day. No more than two clients are on set at a time, one in hair and makeup while the other is in session with Rachel. No males are ever on location while another client is present. All locations have a separate bedroom and sitting parlor for shooting.

Venues may be located up to 30 minutes outside of the city marketed. We have a high repeat rate and are always trying to secure locations that are new for every client. This sometimes requires moving outwards from downtown.

Makeup and Hair Artist
Sessions are a process starting with hair and makeup and is not only an important part of the process but also an important part of the schedule for our events to run smoothly. That said, it is mandatory that all clients go through hair and makeup on events before shooting with Rachel. If clients have any allergies or sensitivity to makeup or product, they are welcome to bring their own products for the makeup artist to use and such information must be noted via the Client Questionnaire sent to clients before their session. We employ exceptionally talented hair & makeup artists who are working for us below their normal day rate so we encourage clients to tip their makeup artist.

Hair and Makeup Change
Clients may inquire with makeup artist to arrange a second hair and makeup look (a change up no longer than 20 minutes) at makeup artist’s quote for desired look change, payable before services are performed, via cash, VenMo, PayPal or CashApp, directly to makeup artist.

Makeup and Hair Satisfaction
It is the Client’s responsibility to make sure she is happy with hair and makeup before shooting. It is imperative that Clients take a look in the mirror to make sure they are happy with the hair and makeup. Due to the use of studio lighting, the makeup will be applied heavier than is normally worn with makeup designed to withstand the bright studio lights. If there are any revisions Client wants made, Client must have our makeup artist perform them before we begin shooting. If she is already with another client, it is ok to ask her to make the revisions before you start or just ask Rachel/Angelina to take care of it and we will get you taken care of before shooting. We all want you to love the way you look! Since Clients have every opportunity to address any issues with hair and makeup prior to shooting, issues brought up after the fact are not grounds for refunds or credits.

Images are for viewing and image selection purposes only. 

Orders
Rachel/Angelina will design all product orders in her/their vision for each client as demonstrated by the Teaser image included with their proofs. Images will be cropped to fit order sizes as Rachel/Angelina see most artistically pleasing. Dissatisfaction with product may be open to negotiation for replacement if client covers all costs for reproduction, lab and shipping unless there was a mistake with lab production. In that case, the lab will replace it. Albums are subject to discoloration at the creases over time. Pano pages are made by folding a print in half. This damages the emulsion and discoloration at the crease line will occur over time. Album samples shown at time of session are true examples of normal wear over time.

Order/Package Upgrades
All clients are welcome to upgrade their packages and/or to purchase product a la carte. It is our pleasure to offer a discount on any a la carte item a client wishes to add to the collection purchased.

Session Client Etiquette
It takes just one client to severely throw off the schedule for an entire day so please arrive on time, no earlier than 15 minutes and any time you are late comes out of your time for hair and makeup. If you are an hour late, Rachel and Angelina will perform the service for you without hair and makeup. No refunds or credits are given if you miss your time for hair and makeup and shoot without it. Many clients like to have a drink to loosen up. We are fine with this, however, we urge clients to not drink and drive.

Payment, Deposit, Cancellation, Rescheduling and Liquidated Damages
All payments made to Rachel Stephens Photography/Angelina Luciana are non-refundable 72 hours after the session is purchased. All packages must be paid in full two weeks before the session date. Session fees are $300 to secure your booking and are non-refundable after 72 hours. Monthly payment plans are offered with no interest.

Making tour events happen is a major production consisting of securing travel, transporting gear, securing location, and securing the time and travel of the makeup and hair artist. Rachel has to prepay all of this and therefore, since this is done months in advance and is non-refundable to her, Rachel must keep a very strict policy on cancellations and rescheduling. 72 hours after you have submitted your payment of your session fee, there are no refunds on the session fee or any payments made towards your product package. There are no cancellations. However, you may cancel and receive a refund if two weeks written notice is given and we are able fill your spot. Session and product package payments are transferable to a friend provided the new client completes a new contract. Please note that 2020 is a test year for Rachel so if your session is booked for a travel event outside of Portland Oregon, she cannot guarantee you can be rescheduled for that same city but you can always be rescheduled to Portland Oregon if you wish to travel to her for your rescheduled session. If your request to reschedule the scheduled session is made with less than two weeks notice before your scheduled session, liquidated damages in the amount of your all monies paid will be charged and will not count as a credit for future bookings.

If you are traveling for your session, Rachel recommends booking your session before booking your airfare and hotel. Sessions cannot be held and are only secured on her calendar with payment. It is recommended to wait to purchase travel until 6 weeks before the event as events sometimes get canceled for lack of adequate bookings. If the event you booked does get canceled, all monies paid will be refunded to client or client has the option to transfer payments to another event. Rachel is not responsible for any fees associated with airline or hotel schedule changes. Please fly in the day before your session, refunds/reschedules will not be given due to same day flight cancellations/delays.

Delivery
Please allow three (3) weeks for design from the date of your order and up to one (1) week for lab production and shipping of product. Product ships either USPS or FedEX.  Due to clients not retrieving their packages and the excess work that creates on our end, we do NOT ship signature required. Clients are provided a tracking number and are responsible for retrieving the package when it is delivered. Clients are responsible for providing a secure address for delivery. Due to the nature of the content, we recommend having your order shipped to your work address or another secure address where it is not left. We can easily mark PRIVATE on the shipping label. If an order shows delivered by the carrier but Client does not have order, RSP is not responsible for stolen packages and the order can be replaced at cost of production and shipping.

Sizes and Color Matching
While every effort is made to meet the Client’s requirements, all sizes quoted by the Photographer are approximate. The Client must inform the Photographer if accurate sizing is critical. Images are cropped to fit product sized chosen by Client. In the event the Client does not want to lose any of the images in cropping, arrangements may be made with RSP to suit her needs. Any dissatisfaction with cropping will be subject to Client covering our cost for lab and shipping on replacement images. Due to limitations of materials and processes, it is not possible to guarantee 100% color matching. However, Rachel will endeavor to provide the closest possible match. All print orders will be cropped to fit order. If proof dimensions are desired for prints, please order the longer dimension print sizes.

Confidentiality
The Photographer acknowledges that in the performance of the photographic services, she may receive information from the Client that is designated by the Client as confidential. Upon request from the Client, the Photographer agrees to make best efforts to keep this information confidential except as required by law.

Venue
This contract shall be interpreted in accordance with the laws of the State of Oregon without regard to any conflicts. All claims, disputes, and lawsuits arising out of or in connection with this Contract from either party shall be resolved or adjudicated in the city of Portland in the State of Oregon.

Defamation and Libel
When clients don’t read the policy before they book that is when we have issues. Some clients think policies don’t apply to them and opt for scare tactics by making up stories online to destroy our reputation. Please be advised that any false comments, reviews or statements made against RSP online will result in legal action as well as rebuttal including full public posting of all correspondence, recorded voice messages, full name, email and client photos. We take intentional harm by way of lies and the defamatory crafting of partial truths to our business very seriously and will pursue in court in the state of Oregon to the full extent of the law.

  • Defamation: An unprivileged false statement of fact which tends to harm the reputation of a person or company. This is a catch-all term for both libel and slander.
  • Libel: Defamation which is written such as on a web site. Most on-line defamation occurs through libel by posting a web page, comment, bulletin board post, review, rating or blog post.
  • Slander: Defamation that is spoken such as through an transcribed video, podcast or audio file.

Images/data supplied in electronic format
For all images/data supplied to the Client in electronic format (including, but not limited to, electronic mail, flash drives, etc.), the Photographer will endeavor to ensure that the data sent is not corrupt and is virus free. The Photographer cannot be held responsible for any damage, disruption and/or loss of any kind that the said media may cause to the Client’s computer or data. The Client agrees to take similar steps to ensure that data sent to the Photographer is not corrupt and/or virus-free.

Destination Private Commissions
Rachel and Angelina are available for private events outside of our scheduled travel events. For all private, extended and destination sessions, Client is responsible for location. Destination session clients are responsible for Rachel’s and Angelina’s travel, hotel accommodations, car service from airport to hotel and back to airport from hotel, rental of lighting equipment for international destination, day rate of $10,000 that covers both Rachel and Angelina, a maximum of 8 clients per day, and a makeup and hair artist is contracted separately through the client or the artist. Rachel is happy to work with any makeup artist but prefers to work with her own contractors. Our day rate for all private destination events includes Collection I valued at $900 for each client. Each client may upgrade her collection at any time.

Copyright and Ownership
a. In accordance with the United States Copyright Laws, the copyright of all images created by the Photographer is owned by the Photographer. Unless the Photographer gives written authorization, the Client is forbidden by law to make prints, reprints, copies, or digital duplication of any images created by the photographer.
b. Reproduction rights (if and when granted) are strictly limited to the uses specified on the Photographer’s invoice. Any license is granted to the Client only upon payment in full of the amount due pursuant to the Photographer’s payment terms.
c. Client may never purchase the copyright of images created by the Photographer.
d. In instances where the Client requests copies of images that the Client has supplied from another photographer, all work is undertaken on the assumption that the Client has obtained written permission from the copyright holder for copies to be made. The Photographer may contact the copyright holder to confirm that authorization to copy the images has been given. The Client agrees to fully indemnify the Photographer for claims or damages or any costs arising from claims for copyright infringement made by a third party.
e. By paying for a portraiture session, Client grants to Rachel Stephens Photography, its assignees, licensees, legal representatives and transferees [“Rachel Stephens Photography”] the right to use Client’s name and likeness for promotional purposes of Rachel Stephens Photography. Client irrevocably authorizes Rachel Stephens Photography to use and publish photographs, pictures, portraits or images in which the Client appears [“Photographs”] in any form, media and manner, including, but not limited to, composite images or distorted representations, for the purposes of publicity, illustration, commercial art, advertising, and publishing (including publishing in electronic form), for lawful uses as may be determined by the Rachel Stephens Photography. Client waives all rights to review or approve any uses of the Photographs unless specific opt out of use of images is noted on Client Intake Form.
Waiver of Liability, Assumption of Risk, and Indemnity Agreement
Waiver: In consideration of permission to use, for the duration of the portrait session, the property, facilities, staff, equipment and services of Rachel Stephens Photography, I, for myself, my heirs, personal representatives or assigns, do hereby release, waive, discharge, and covenant not to sue Rachel Stephens Photography, its directors, officers, employees, and agents from liability from any and all claims including the negligence of Rachel Stephens Photography resulting in personal injury, accidents or illnesses (including death), and property loss arising from, but not limited to, participation in activities, classes, observation, and use of facilities, premises, or equipment. I acknowledge, agree and represent that I understand the nature of The Activity and that I am qualified, in good health and in proper physical condition to participate in such Activity. I further agree and warrant that if any time I believe conditions to be unsafe, I will immediately discontinue further participation in the Activity. 
Assumption of Risks: This use of Rachel Stephens Photography’s property, facilities, staff, equipment, and/or services carries with it certain inherent risks that cannot be eliminated regardless of the care taken to avoid injuries. Rachel Stephens Photography purchases space in hotels and studios for location sets and is not associated with these locations in any way. I have read the previous paragraphs and I know, understand, and appreciate that risks may occur in the activities made possible by Rachel Stephens Photography.

I hereby assert that my participation is voluntary and that I knowingly assume all such risks.

Indemnification and Hold Harmless
I also agree to INDEMNIFY AND HOLD Rachel Stephens Photography, HARMLESS from any and all claims, actions, suits, procedures, costs, expenses, damages and liabilities, including legal fees brought as a result of my involvement in a portrait session with Rachel Stephens Photography, and to reimburse them for any such expenses incurred.
